Housing Accommodations and Modifications

With three decades of experience representing individuals with disabilities, as well as local and national fair housing organizations, and litigating seminal fair housing cases in the Eleventh Circuit Court of Appels, Matt Dietz has witnessed firsthand the transformative power of the Fair Housing Act (FHA). The FHA prohibits discrimination and guarantees equal housing opportunities, requiring providers to permit reasonable accommodations and modifications that are vital for independence, health, and community inclusion. The consequences of denial are profound, often resulting in instability, hardship, and even displacement from one’s home.

Reasonable accommodations typically involve changes to policies or procedures in order to allow a person to have an equal opportunity to live in his or her home and fully benefit from the services and benefits of their home or property. This may include allowing assistance animals, designating accessible parking, adjusting occupancy limits, or modifying rent payment terms. Reasonable modifications call for physical alterations, such as installing ramps, grab bars, or widening doorways. Despite clear legal mandates, housing providers persistently misunderstand or misapply these requirements, confuse accommodations with modifications, overreach for medical documentation, impose unlawful fees, or deny valid requests without proper analysis. These mistakes, repeated over my decades of practice, create unnecessary barriers for people with disabilities.

Matthew Dietz’s work has centered on guiding clients through these challenges with legal precision and practical strategy. Structuring requests in accordance with HUD guidance, clearly articulating the nexus between disability and requested change, limiting disclosure to strictly necessary information, and responding decisively to improper denials or delays have proven essential.

The way a request is framed often determines its outcome. A well-crafted, legally compliant request signals sophisticated awareness and increases the chance of voluntary compliance, while creating a clear evidentiary record should enforcement be necessary.
